Exchange Agreement between AS-BUILT LEARNING EXCHANGE (ABLE) and (BUSINESS / ASSOCIATION / REGULATOR)

BACKGROUND

ABLE provides technical services to Businesses, Associations and Regulators in the Western Australian housing industry who are willing to participate in the development of Local Practice Information & Resources.

The underpinning Open Exchange proposition is that it is more affordable to compete for work and collaborate on solutions. In an industry where technical issues have so much in common, Open Exchange provides a more effective way to learn about issues and a more efficient way to contribute to development of recognised solutions for common local practices.

IT IS AGREED

Purpose and Duration

This Exchange Agreement records the undertakings and describes the exchange between (Business/Association/Regulator) and ABLE for Year. The Exchange Agreement will be extended beyond this date on a year by year basis unless a party gives 30 days notice terminating the Exchange Agreement.

Common Practice Exchange

ABLE agrees to assist (Business/Association/Regulator) in the development of better local practices.

(Business/Association/Regulator) agrees that the outcomes of that work can be used by ABLE for the ongoing development of Local Practice Information & Resources.

ABLE’s Obligations

ABLE agrees to:

  • Recognise (Business/Association/Regulator) as an Exchange Partner.
  • Work on an in-confidence basis.
  • Only disclose generic information when developing Local Practice Information & Resources.
  • Provide (Business/Association/Regulator) with Open Exchange Use rights to Local Practice Information & Resources.
  • Review and develop Local Practice Information & Resources as issues emerge and publish notes on the ABLE website when amendments are made (ref: Amendment Register).
  • Abide by the terms of this Agreement and the Standard Terms.

(Business/Association/Regulator)’s Obligations and Acknowledgements

(Business/Association/Regulator):

  • Agrees that ABLE can recognise (Business/Association/Regulator) as an Exchange Partner on the ABLE website (ref: Supports Partners and Contributors).
  • Agrees that it will only use material for the purpose declared to ABLE.
  • Agrees that it will provide ABLE with feedback about material development, user experiences and other issues likely to inform the continued development of Local Practice Information & Resources.
  • Agrees that copyright ownership of Local Practice Information & Resources, material derived from existing Local Practice Information & Resources, and material developed by ABLE whilst providing technical services remains with ABLE.
  • Acknowledges that it has read and agrees to be bound by the Conditions of Use that apply to ABLE material.
  • Agrees that when fee based services are requested it will pay ABLE the agreed fee and abide by the Standard Terms.
